By accessing or using the NawaCloud website, portal, or managed hosting services, you agree to be bound by these Terms of Service. If you use the service on behalf of a company or organization, you represent that you have authority to bind that entity.
2. Service Scope
NawaCloud provides managed cloud hosting, application deployment, virtual server environments, client portal access, and related operational services. Specific features, service levels, quotas, or deliverables may vary by plan, project scope, or written agreement.
3. Accounts and Access
Customers must provide accurate account information and keep credentials secure. You are responsible for actions performed through your account, including actions taken by team members, contractors, or anyone using your login credentials or access tokens.
4. Acceptable Use
You may not use the service for unlawful activity, malware distribution, unauthorized scanning, spam, phishing, abusive content, intellectual property infringement, attempts to bypass security controls, or any activity that may disrupt our systems, customers, vendors, or public networks.
5. Orders, Billing, and Renewals
Fees, plan scopes, and billing periods will be described in the applicable order, portal, quote, or invoice. Unless stated otherwise, charges are due in accordance with the billing schedule communicated at the time of purchase. Failure to pay may result in limitation, suspension, or termination of service.
6. Provisioning and Service Availability
Provisioning timelines are estimates and may vary depending on order complexity, verification steps, technical dependencies, customer responsiveness, or third-party conditions. We aim for reliable service delivery but do not guarantee uninterrupted or error-free operation.
7. Customer Content and Workloads
Customers retain responsibility for applications, data, licensed software, and activity running inside their environments. You must ensure you have the necessary rights to use and deploy all software and data stored or processed through the service.
8. Maintenance, Suspension, and Termination
We may perform maintenance, emergency remediation, or service changes required for security, stability, legal compliance, or operational integrity. We may suspend or terminate accounts for non-payment, abuse, fraud, policy violations, legal risk, or activity that threatens the platform or other customers.
9. Intellectual Property
All rights in the NawaCloud website, portal, branding, software layer, workflows, and service materials remain the property of PT Abhinawa Sumberdaya Asia or its licensors, except for customer-owned data and content.
10. Warranty Disclaimer
Unless explicitly stated in a written agreement, the service is provided on an "as available" and "as is" basis. We disclaim implied warranties to the extent permitted by applicable law, including fitness for a particular purpose, merchantability, and non-infringement.
11. Limitation of Liability
To the maximum extent allowed by law, PT Abhinawa Sumberdaya Asia will not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, business interruption, or data loss. Our aggregate liability relating to the service will generally not exceed the amount paid by the customer for the affected service during the relevant billing period, unless a written contract states otherwise.
12. Indemnity
You agree to defend, indemnify, and hold harmless PT Abhinawa Sumberdaya Asia from claims, losses, liabilities, and costs arising from your content, your use of the service, your breach of these terms, or your violation of law or third-party rights.
13. Changes to the Service or Terms
We may improve, modify, replace, or discontinue parts of the service from time to time. We may also update these Terms of Service. Continued use after an update constitutes acceptance of the revised terms.
14. Governing Principles
These terms are governed by the laws applicable to PT Abhinawa Sumberdaya Asia, unless a separate written agreement provides otherwise.
